In this interview broadcast on the Cumhuriyet channel, Prof. Dr. Murat Volkan Dülger answered questions on current investigations and the 11th Judicial Package. The first subject was the confidentiality of the investigation stage and the presumption of innocence; the legal consequences of passing investigation material to the press were assessed in the light of Article 157 of the Code of Criminal Procedure (CMK), Article 27 of the Regulation on Apprehension, Custody and Taking of Statements (Yakalama, Gözaltına Alma ve İfade Alma Yönetmeliği) and the offence of breaching the confidentiality of an investigation under Article 285 of the Turkish Criminal Code (TCK). The interview then turned to obtaining scientific opinions from experts outside the Council of Forensic Medicine, the evidential value of statements by anonymous witnesses, the right of the defence to question those witnesses, and the practice of pre-trial detention. In the final part, the amendments made to the TCK by the 11th Judicial Package, the measure of suspension of accounts under Article 128/A of the CMK and the new rules on the execution of sentences were addressed; conditional release, probation and the deterrent effect of penalties were discussed, as was the relationship between criminal law and morality.
