About the video

The basic principle of criminal law is that everyone is responsible for their own act. The person who uses the gun and commits the crime is directly liable for it; this does not mean, however, that the owner of the gun can never be liable.

If you gave your gun to someone knowing that it would be used in a crime, you may be liable as an accessory under the rules on complicity. If you did not hand it over knowingly but left it within easy reach without taking the necessary safety measures, and someone was killed or injured as a result, you may be held liable for negligent homicide or negligent injury. In negligent liability each person is punished according to their own fault.

Legal basis: Turkish Criminal Code (Law No. 5237), Arts. 22, 37, 39, 85 and 89.
