This is the second part, after the break, of the Criminal Procedure Law II lecture held on the same day. This part covers compensation for protective measures: the protective measures for which compensation may be claimed, the relationship of the provision with the Constitution and the European Convention on Human Rights (ECHR), and the cases listed in the relevant article of the Code of Criminal Procedure (CMK) are explained by reading out the text of the article. It touches on the criticisms concerning the amounts of compensation and the effectiveness of the practice, on the fact that compensation actions arising from the decisions of judges and prosecutors are brought against the State, and on the State’s right of recourse. It then deals with the time limits for a compensation claim, the competent court, the procedure for trial and payment, the recovery of compensation paid, and the persons who may not claim compensation. The drafting and return of the indictment are left to the next lecture. The lecture is based on the legislation as it stood on the date of the recording.
