This is the first part of the recording of the Criminal Procedure Law II lecture, streamed live on YouTube and Instagram during the pandemic. After a brief reminder of physical examination and the taking of samples from the body, covered in the previous lecture, it turns to molecular genetic analyses, considering the purpose of the analysis, the rule that the samples taken may not be used for any other purpose, the relationship with personal data protection, the power to decide and the appointment of the expert. In this context it explains the debate over the impartiality, as experts, of forensic laboratories attached to the law enforcement agencies, and the confidentiality of the results of genetic analysis. It then covers the determination of physical identity and the relationship of this measure with the Law on the Duties and Powers of the Police. The final part of the lecture touches on decisions to block access under Law No. 5651 and on the debate as to whether these can be regarded as protective measures. There are interruptions in the recording caused by connection problems in the university’s distance-learning system; the lecture reflects the legislation as it stood on the date of the recording.
