This is a recording of an interview with Prof. Dr. Murat Volkan Dülger, who appeared as a guest on a television programme broadcast on Habertürk TV. The interview began with the phenomenon of impunity; the length of investigations and trials, the amendments made to the legislation on the execution of sentences, and the practice of probation and conditional release were considered. The discussion then turned to the nature of pre-trial detention as a protective measure, the grounds for detention under Article 100 of the Code of Criminal Procedure (CMK) and the problem of detention turning into punishment in advance. In the final part, the question whether the problem stems from the legislation or from its application, merit in the judiciary and legal education were discussed, and an older judicial practice in which bag-snatching was classified as robbery was given as an example with regard to deterrence.
