About the video

Prof. Dr. Murat Volkan Dülger was the guest of a programme presented by Gözde Kuyumcu on Bloomberg HT Radyo, in which the protection of personal data was discussed. First, the definition of personal data in Law No. 6698 on the Protection of Personal Data (KVKK) was explained with examples, and cookies and the tracking of online behaviour for advertising purposes were addressed. The discussion then turned to the concepts of data controller, data processor and data subject, to explicit consent and the conditions for processing in Articles 5 and 6 of the KVKK, and to the validity of consent imposed as a precondition of a contract. Within the framework of the rules in force at the time of recording, the programme covered the application to the data controller followed by a complaint to the Personal Data Protection Board, administrative fines, notification of a data breach to the Board, actions for damages and the offences in Articles 135, 136 and 138 of the Turkish Criminal Code (TCK). In response to a listener’s question, the procedure for the blocking of access under Law No. 5651 was touched upon; the territorial application of laws, Directive 95/46/EC of the European Union and the General Data Protection Regulation (GDPR), and the concept of privacy were also addressed.
