About the video

This is a recording of the sessions held on 9 December 2020 as part of an online training event on personal data protection law organised by the IT Law Club (Bilişim Hukuku Kulübü); it consists of three presentations and question-and-answer parts. In the first session, Prof. Dr. Murat Volkan Dülger addressed the transfer of personal data abroad within the framework of the rules in force at the time of the recording. In this context, the session dealt with explicit consent under Article 9 of Law No. 6698 on the Protection of Personal Data (KVKK), the routes of countries with adequate protection and of permission from the Personal Data Protection Board based on a written undertaking, binding corporate rules, and the Board’s decisions on transfers abroad, in particular its decision of 22 July 2020 on transfers made in reliance on Convention No. 108. In the question-and-answer part, the use of e-mail services whose servers are located abroad, the obtaining of explicit consent by electronic means and the appointment of representatives by social network providers were discussed. In the second session, Dr. Serdar Talas explained the relationship between the offences concerning personal data in the Turkish Criminal Code (TCK) and cybercrimes, the practice of the Court of Cassation and the problem of concurrence of offences. In the third session, Assoc. Prof. Dr. Mesut Serdar Çekin and a further speaker addressed the protection of personal data in employee–employer relations during the Covid-19 period, in terms of the processing of health data, the validity of explicit consent in the employment relationship, the employer’s obligations arising from labour law and the role of the workplace physician.
