In the online talk Fifth Dimension (5. Boyut) of 20 January 2021, published on the Lerzan Erkan channel, Prof. Dr. Murat Volkan Dülger answered questions on personal data protection law. The first part covered the state of legislation, practice and awareness under Law No. 6698 on the Protection of Personal Data (KVKK), the difficulties arising in the transfer of personal data abroad, and the question whether administrative fines imposed by the Personal Data Protection Board (the Board) should be challenged before the criminal judgeships of peace or before the administrative courts. The discussion then turned to the obligations of the data controller, compliance work in companies, the rights of the data subject under Article 11 of the KVKK, and the procedure requiring an application first to the data controller and then to the Board. In connection with the WhatsApp debate that was current at the time, the difference between the European Union and the United States of America in their approach to data protection, the use of metadata and the deterrent effect of administrative fines were discussed. In response to questions from participants, the processing of CVs and health data in human resources, the list of safe countries, data processing in law offices, children’s personal data and their sharing on social media, and the use of health data in court proceedings were assessed. The talk ended with a reference to the need to review the KVKK within the framework of the rules in force at the time of the recording.
