This is a recording of the talk given by Prof. Dr. Murat Volkan Dülger under the title The Effects of the Covid-19 Pandemic on Personal Data Protection Law (Covid-19 Pandemisinin KVK Hukukuna Etkileri) at a workshop on personal data protection, published on the channel of the Lawyers’ Association (Hukukçular Derneği). The talk dealt with the fact that health data are among the special categories of personal data listed in Article 6 of Law No. 6698 on the Protection of Personal Data (KVKK), the mobile applications used by states to combat the pandemic and the question of transparency as to which data are processed in these applications, by whom, for what purpose and for how long. It then addressed temperature checks at entrances and the question of who may process health data, the balance of interests between public health and the protection of the individual’s personal data, and health data kept in personnel files. Finally, the transfer of health data abroad and the statement that the KVKK would be amended were assessed within the framework of the rules in force at the time of the recording.
