This is the recording of an online conversation dated 16 December 2020; Murat Volkan Dülger and a lawyer working in the field of IT law were the guests, and a moderator chaired the conversation. It first discusses the amendments made to Law No. 5651 since 2007 and the need that prompted the social media legislation which entered into force in July of the same year. The obligation imposed on social network providers to appoint a representative and the graduated sanctions consisting of fines, an advertising ban and bandwidth reduction are examined by comparison with the German legislation. The decisions of the criminal judgeships of peace on the blocking of access, legal certainty and the proposal to establish a specialised court for IT matters are considered. The conversation goes on to discuss the economic and social function of social media, the consequences of a possible restriction of access and the referral of the legislation to the Constitutional Court. The final part deals with consultation of interested parties in the law-making process and the theory of enemy criminal law.
