This is the recording of an Instagram live broadcast dated 15 April 2020, organised by the Legal Clinics Club of the Faculty of Law of Trabzon University; Prof. Dr. Murat Volkan Dülger answered the questions of a student member of the club and of viewers. At the start of the broadcast, the age of consent to sexual intercourse under the Turkish Criminal Code (TCK) and the method of law-making were addressed in connection with the legislation on the execution of sentences adopted at that time and a provision whose inclusion in that legislation had been raised. The discussion then turned to the processing of health data during the Covid-19 pandemic, the difficulties in applying Article 6 of Law No. 6698 on the Protection of Personal Data (KVKK), temperature checks at workplace entrances and the statement of the Personal Data Protection Board on mobile applications, which relied on the exemption in Article 28. The balance between security and freedom was discussed with reference to monitoring practices in China, together with the keeping of files on individuals, the collection of data by private companies through social media and cookies, and targeted advertising. In the question section, rumours about the monitoring of WhatsApp correspondence, the proposed amendment to Law No. 5651 concerning social network providers, Articles 134 and 135 of the Code of Criminal Procedure (CMK), the scope of the concept of personal data and whether the pandemic could be regarded as an exception under the KVKK were assessed. The final part dealt with the security of online meeting software, the use of personal data in election campaigns and the transfer of personal data abroad through cloud services.
