In this recording, broadcast live as part of the online talk series of the Dİ-AR Dicle Mediation Centre (Dİ-AR Dicle Arabuluculuk Merkezi), Prof. Dr. Murat Volkan Dülger answered questions on personal data protection law. The talk opened with the emergence of the idea of protecting personal data and the link between Council of Europe Convention No. 108, Directive 95/46/EC, the General Data Protection Regulation (GDPR) and Law No. 6698 on the Protection of Personal Data (KVKK). It then turned to the concept of personal data, the position of public institutions and bodies under the KVKK, and the function of the obligation to register with the Data Controllers’ Registry (VERBİS). In response to viewers’ questions, the discussion covered camera recording in healthcare institutions, the difference between the obligation to inform and policy documents, explicit consent and statutory retention periods for health data, the processing of employees’ health data by employers, and whether lawyers are to be regarded as data controllers. The final part addressed, within the framework of the legislation in force at the time of recording, the nature of the data controller’s liability, the classification of the KVKK as a piece of administrative law, the remedy against administrative fines imposed by the Personal Data Protection Board, and reliance on more than one condition for processing.
