The article examines the protection of personal data in the context of human rights and fundamental rights and freedoms. It first sets out the concept of personal data and the international and national rules. It then discusses the place of personal data protection within the right to privacy and the other fundamental rights, and whether it is an independent right. The assessment is made in the light of the judgments of the European Court of Human Rights and the Constitutional Court.
