Today, with the increase in the scale and variety of surgical interventions that can be carried out on human beings in particular, the need for a new approach to the question of the lawfulness of such medical interventions has begun to be felt. By the nature of their profession, physicians interfere with a person’s bodily integrity, and by their conduct they may even either save the person’s life or cause the person’s death. Determining which act or omission of the physician, at which moment, will constitute lawful or unlawful conduct is of the utmost importance for criminal law.
