This year is the 20th anniversary of the entry into force of the Turkish Criminal Code (TCK), the Code of Criminal Procedure (CMK) and the Law on the Execution of Sentences. Exactly 20 years have passed since the criminal law reform, in which the basic statutes of criminal law were rewritten on a new understanding and brought into force. But was there really a reform? Unfortunately not; on the contrary, the criminal justice system has gone backwards in the full sense of the word. There are many different reasons for this, but the regression stems largely from practice rather than from the norms of criminal law. Of course, we also see in it the effect of amendments made according to day-to-day politics rather than criminal policy. Can this regression be reversed?

Yes, but this requires a society that wants it and, in the position of lawmaker, politicians whom society has elected with that wish. Otherwise things get worse and it is not possible to move forward. In this context, we see that hundreds of amendments have been made to the TCK, the CMK and the Law on the Execution of Sentences from 1 June 2005 to the present. By thirty-seven laws, two decree-laws and eleven Constitutional Court decisions, four new articles have been added to the TCK, various paragraphs of seven articles have been annulled by the Constitutional Court and a total of one hundred and twenty articles have been amended, forty-three of them more than once. The CMK, for its part, has been subjected to far more amendments than the TCK.
