The study deals with mistake, one of the most disputed subjects in criminal law: it examines what criminal codes understand by mistake and which consequences are attached to which type of mistake. Mistake that excludes intent is distinguished from mistake that affects culpability; mistake as to the qualified forms of an offence and mistake as to the factual conditions of grounds of justification are treated as mistake that excludes intent. The differences between aberratio ictus and mistake as to the person are also discussed.
