This is a recording of an interview published on Habertürk’s online channel on 16 February 2023, in which Prof. Dr. Murat Volkan Dülger was the only guest. Following the earthquakes that struck Kahramanmaraş, the interview dealt with the collection and preservation of evidence, the Legal Initiative for the Earthquake (Deprem için Hukuki Girişim), which prepared templates for criminal complaints, and the “Enkaz Radarı” mobile application of the Union of Turkish Bar Associations. It then addressed criminal liability in respect of municipal officials, building inspection firms and engineers as well as contractors, the question of whether the cases should be brought together in a single trial, heard by specialised courts or joined by district or by contractor, and the effect of the zoning amnesty on criminal liability. In the final part, the distinction between dolus eventualis and conscious negligence, the level of the penalty provided for, the rules on the execution of sentences and the authorisation procedure for the prosecution of public officials were assessed within the framework of the legislation in force at the time of the recording.
