In a broadcast on the Cumhuriyet channel, the proposals for legislation raised in connection with the resolution process (çözüm süreci) were discussed with Prof. Dr. Murat Volkan Dülger. The conversation first dealt with the proposal to take a statute enacted in 1925 as a model, and then with the difference between a non-liability provision for those taking part in the process and immunity. The relationship between an amnesty law and social peace was considered with reference to the views of Cesare Beccaria, and the position of such a law in the light of the constitutional principle of equality and of review by the Constitutional Court was examined. In the final part, the distinction between a state governed by the rule of law and a state governed by statutes, the binding nature of court decisions, the Constitutional Court’s power to review decisions of Parliament and the binding force of the Constitution were discussed.
