In an interview broadcast on the main news bulletin of Habertürk TV on 18 October 2022, Prof. Dr. Murat Volkan Dülger assessed the legislation publicly referred to as the disinformation law, which had entered into force on publication in the Official Gazette. The elements of the offence of publicly disseminating information misleading the public, introduced by Article 29 of the legislation, were examined using the example of posts about inflation figures, and the possible consequences of the provision for freedom of expression and self-censorship were addressed. The principle of criminal law as a last resort, the remedy of compensation for violations of personality rights, and the criteria for restrictions under Article 10 of the European Convention on Human Rights (ECHR) and Articles 26 and 27 of the Constitution were assessed. Finally, the amendments made by the same law to the Press Law and to Law No. 5651 and the application lodged by the main opposition party with the Constitutional Court were touched upon.
