In this short recording, taken from a talk on patients’ rights and published on the TEKNO POLITIK channel, Prof. Dr. Murat Volkan Dülger addressed the protection of personal data by means of criminal law. The talk dealt with Articles 135, 136 and 138 of the Turkish Criminal Code (TCK), which concern the unlawful recording of personal data, the unlawful giving or dissemination of such data and the failure to destroy data after the prescribed period has expired, and with the basis of these provisions in Article 20 of the Constitution. The fact that, at the time of recording, a specific law on the protection of personal data had not yet been enacted, and the uncertainties this created, were also considered.
