When “custody” is mentioned, most people do not know what their rights are, or know them only in part. Yet in a state governed by the rule of law, a person who is taken into custody has very important and critical rights.
- When a suspect is taken into custody, can he or she call a lawyer or ask the bar association for one? - What is the right to remain silent? What are its effects and consequences? If the right to remain silent is exercised, will pre-trial detention follow?
- Which rights must the person be told about during this procedure? What happens if they are not? In this video I explain these points briefly and clearly.
