In a live broadcast on the Hukuk Akademisi channel on 15 April 2020, Prof. Dr. Murat Volkan Dülger discussed problems of personal data protection law with the lawyer Hasan Selçuk Turan, who also has a background in computer engineering. The conversation began with the concepts of personal data and identifiability, using the example of sales information shared by a company; it continued with the criterion for anonymisation, the question whether a person has a right to object to the anonymisation of his or her data, and the debate on biometric data. Next, the statement of the Personal Data Protection Authority on the processing of location data during the pandemic was assessed in the light of Articles 6 and 28 of Law No. 6698 on the Protection of Personal Data (KVKK), and the importance of critical debate on decisions of the Personal Data Protection Board and of the Court of Cassation was addressed. The speakers debated whether Convention No. 108 can be applied directly to transfers of personal data abroad under Article 90 of the Constitution, and the place of explicit consent. In the last part of the broadcast, the question whether general artificial intelligence (AI) is possible, the concept of will and its link with the principle of culpability in criminal law were examined; the conversation ended with remarks on the place of philosophy and sociology of law in legal education.
